Can You Still Get an Abortion in Missouri?

The overturning of Roe v. Wade left many confused about the laws governing abortion and what it meant for their state. To better understand this, we’ll discuss what this overruling meant and how it impacts the U.S.For Missouri specifically, the state outlawed elective or induced abortion in June of 2022. However, an exception is permitted for patients with an emergent life-threatening diagnosis.


What Did Overturning Roe v. Wade Really Do?

In 1973, the Supreme Court ruled it was a woman’s constitutional right to receive an elective abortion without the need for a life-threatening diagnosis behind that decision. However, in June of 2022, the Supreme Court overturned this ruling. Instead, as Missouri’s Statute states, “The authority to regulate abortion is returned to the people and their elected representatives.” 


This return of power means that the people now have the right to decide what laws their state will observe and seek elective delegates to speak for them on their behalf.


What Are MO Current Abortion Laws?

Currently, the Missouri law states, “ …no abortion shall be performed or induced upon a woman, except in cases of a medical emergency.  Any person who knowingly performs or induces abortion of an unborn child in violation of this subsection shall be guilty of a class B felony…”

So, although Missouri does not allow abortion, if a mother’s life is in danger, the state law protects her by not withholding any treatment necessary to save her life.
